These terms form a legally binding agreement between you and FemNEST (also "we", "us" and "our") governing your use of our website, our community platform, and your attendance at FemNEST events.
By purchasing a ticket to a FemNEST event, joining the FemNEST community once launched, or otherwise using our services, you agree to be bound by these terms and our Privacy Policy, which is incorporated by reference. If you do not agree with these terms, we are unable to provide our services to you.
Unless the context requires otherwise, reference to the singular includes the plural and vice versa. Headings are for assistance only and do not affect interpretation.
Definitions
- "Attendee" means anyone who purchases a ticket to, or attends, a FemNEST event.
- "Member" means anyone who joins the FemNEST community platform (currently in development).
- "Event" means any in-person or online gathering organised or hosted by FemNEST, including panels, workshops and social events.
- "Community" means FemNEST's online community platform and associated spaces, once launched.
1. Events and tickets
1.1 Tickets are currently sold via third-party ticketing platforms (such as Eventbrite or an equivalent provider). Booking a ticket through such a platform is also subject to that platform's own terms and conditions, which sit alongside these terms.
1.2 We are not responsible for the availability, security or functioning of any third-party ticketing platform.
1.3 Ticket prices, capacity and event details are set out on the relevant event listing at the time of booking.
1.4 We reserve the right to change speakers, venue, timing or format of an Event where reasonably necessary, and will notify Attendees where possible.
2. Payments and refunds
2.1 Payment for tickets is processed by the relevant third-party ticketing platform, not directly by FemNEST.
2.2 Under no circumstances will a refund be provided by FemNEST to an Attendee unless we agree to do so at our sole discretion.
2.3 Where a refund is agreed, it will be issued via the original ticketing platform and payment method. Processing times are outside of our control and depend on the platform and your bank.
2.4 If FemNEST cancels an Event, we will offer Attendees either a refund or a transfer to a future Event.
3. Community membership (coming soon)
3.1 FemNEST is developing a paid community membership, to launch in due course. These terms will apply to that membership once live, together with any additional membership-specific terms published at that time, for example on subscription fees, billing cycles, and the platform used to host the Community.
3.2 We will notify prospective Members of the chosen platform, pricing and any specific membership rules before the Community goes live.
3.3 Members must keep their account details accurate and confidential, and must not share login access with anyone else.
3.4 We may suspend or terminate a Member's access for breach of these terms, including the code of conduct below.
4. Code of conduct
4.1 At our Events and within our Community, you must not:
- behave in a way that is abusive, harassing, discriminatory or defamatory towards any other person;
- infringe the rights, including intellectual property rights, of any other person;
- engage in conduct that breaches any applicable law or creates liability for FemNEST.
4.2 We may remove any Attendee or Member from an Event or the Community, without refund, for breach of this code of conduct.
5. Photography and media
5.1 Our Events are regularly photographed and/or filmed for use in FemNEST's marketing, social media (including Instagram), website and newsletter.
5.2 By attending a FemNEST Event, you consent to being photographed or filmed and to that content being used by FemNEST for these purposes.
5.3 If you would prefer not to appear in photography or video, please let a member of the FemNEST team know on arrival and we will take reasonable steps to accommodate this.
6. Intellectual property
6.1 All content, branding and materials created by FemNEST, including the DELIA Model™ and the FemNEST name and logo, remain the property of FemNEST (or its licensors) and may not be used without our permission.
6.2 Any content shared by Members or Attendees within the Community remains their own, but by posting it they grant FemNEST a non-exclusive licence to display it within the Community for its intended purpose.
7. Confidentiality and data protection
7.1 We process personal data in accordance with our Privacy Policy, which forms part of these terms.
7.2 Members and Attendees must not use other Members' or Attendees' personal information, obtained through the Community or an Event, for any purpose other than that for which it was shared.
8. Liability
8.1 FemNEST shall not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any indirect or consequential loss suffered by a Member or Attendee arising from their use of our services, Events or Community, save that nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, or any other liability which cannot be excluded under the laws of Cyprus.
8.2 Attendance at in-person Events is at the Attendee's own risk, save as set out above.
9. Complaints
If you are unhappy with any aspect of our services, please contact us at hello@yourfemnest.com so that we can investigate. We will try to provide an amicable resolution, where possible, within 7 days.
10. General
10.1 We may amend these terms from time to time. Continued use of our website or Community, or attendance at future Events, after such changes confirms your agreement to the amended terms.
10.2 If any provision of these terms is found unenforceable by a competent authority, the remaining provisions will continue in full force and effect.
10.3 No third party is intended to have any rights under or in connection with these terms.
11. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), are governed by the laws of Cyprus, and the parties irrevocably submit to the exclusive jurisdiction of the courts of Cyprus.
